PREAMBLE

The Seller is the publisher of Vacances & séjours organisés. marketed through its website (https://www.dahuwakefamily.com). The list and description of goods and services offered by the Company can be consulted on the above-mentioned site as well as its sales pages.

ARTICLE 1 - PURPOSE

The present General Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products and Services offered by the Seller.

ARTICLE 2 - GENERAL PROVISIONS

These General Terms and Conditions of Sale (GTCS) apply to all sales of Products or Services made through the Company's website and are an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify the present terms and conditions at any time by publishing a new version on its website. The applicable GTC shall be those in effect on the date of payment (or the first payment in the case of multiple payments) of the order. These GTC are available on the Company's website at the following address: https://www.dahuwakefamily.com/legal . The Company also ensures that their acceptance is clear and without reservation at the time of purchase. The Client declares that he/she has read all of these General Terms and Conditions of Sale, and, if applicable, the Special Terms and Conditions of Sale related to a product or service, and accepts them without restriction or reservation. The Customer acknowledges that he/she has received the necessary advice and information in order to ensure that the offer meets his/her needs. The Customer declares that he/she is legally able to contract under French law or that he/she can validly represent the individual or legal entity for which he/she is contracting. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

ARTICLE 3 - PRICES

The prices of the products sold through the websites are indicated in Euros, all taxes included, and are precisely determined on the pages describing the Products. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums are not the responsibility of the Seller. They shall be borne by the Buyer and are the Buyer's responsibility (declarations, payment to the competent authorities, etc.). The Company reserves the right to change its prices at any time in the future. The telecommunication costs necessary for access to the Company's websites shall be borne by the Customer. If applicable, the delivery costs are also to be paid by the Client.

ARTICLE 4 - CONCLUSION OF THE CONTRACT ONLINE

The Customer must follow a series of steps specific to each Product or Service offered for sale by the Vendor in order to place an order. However, the steps described below are systematic: - Information on the essential characteristics of the Product; - Choice of the Product, if necessary of its options and indication of the essential data of the Customer (identification, address...); - Acceptance of the present General Conditions of Sale. - Verification of the elements of the order and, if necessary, correction of errors. - Follow-up of payment instructions and payment of products. - Delivery of the products and/or validation of the services. The Customer will then receive confirmation by e-mail of the payment of the order, as well as an acknowledgement of receipt of the order confirming it. He will receive a .pdf copy of the present general conditions of sale. For delivered products, this delivery will be made to the address indicated by the Customer. In order to complete the order correctly, the Customer undertakes to provide truthful identification details. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.

ARTICLE 5 - PRODUCTS AND SERVICES

The essential characteristics of the goods, services and their respective prices are made available to the buyer on the company's websites. The Customer certifies that he/she has received details of the delivery charges as well as the terms of payment, delivery and execution of the contract. The Seller undertakes to honour the Customer's order within the limits of available stocks only. In the absence of such availability, the Seller shall inform the Customer. This contractual information is presented in detail and in French. They are the subject of a summary and a confirmation during the validation of the order. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The duration of validity of the offer of the Products as well as their prices is specified on the sales pages of the products, as well as the minimum duration of the proposed contracts when these relate to a continuous or periodic supply of products or services. Except in the case of special conditions, the rights granted hereunder are granted solely to the natural person who signs the order (or the person who holds the email address communicated). In accordance with the legal provisions concerning conformity and hidden defects, the Seller shall refund or exchange the defective products or those that do not correspond to the order. The refund can be requested by contacting the Seller by email or simple letter. 

ARTICLE 6 - RETENTION OF TITLE CLAUSE

The products & services remain the property of the Company until full payment of the price.

ARTICLE 7 - DELIVERY TERMS

The products are delivered to the address of delivery which was indicated at the time of the order and the time indicated. This period does not take into account the preparation time of the order. When the Customer orders several products at the same time, they may have different delivery times and be delivered in different ways. The Seller provides a telephone contact point (cost of a local call from a landline) indicated in the order confirmation email in order to follow up the order. The Seller reminds that at the moment when the Customer takes physical possession of the products, the risks of loss or damage of the products are transferred to him. In case of withdrawal from the sale, the costs of returns are to be borne by the Customer.

ARTICLE 8 - AVAILABILITY AND PRESENTATION

Orders will be processed within the limits of our available stocks or subject to the stocks available from our suppliers.

ARTICLE 9 - PAYMENT AND TOURIST TAX

Payment is due immediately upon ordering, including for pre-ordered products and services. The customer can pay by credit card or bank transfer. The secure online payment by credit card is made by our payment provider. The information transmitted is encrypted according to the rules of the art and cannot be read during transport on the network. Once the payment is made by the Customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay by card is irrevocable. By communicating his banking information at the time of the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale shall be immediately cancelled by operation of law and the order cancelled.

TOURIST TAX
Les taxes de séjours ne sont pas incluses dans les tarifs. Le montant de celle-ci est fixée à 1.11€ par adulte et par jour et sont gratuites pour les enfants de moins de 18 ans. Le montant de cette taxe est fixée par la CALI de Libourne dans le cadre des séjours au Dahu Wake Park et par Hip-Notics Cable Park dans le cadre des séjours en Turquie. La collecte de celle-ci est réalisée sur place à votre arrivée. Elle peut être sujette à variation. Pour être informée du montant exact pour votre séjour, merci de demander un devis par le formulaire de réservation.  

ARTICLE 10 - WITHDRAWAL PERIOD

Booking, modification and cancellation conditions for stays at Hip-Notics.

Reservation
All reservations must be accompanied by a deposit of 100€ per person and per week (7 nights) of camp. The stay or camp is validated only once the payment is made.

All reservations must be made within the dates of said stay or camp. It is possible to make a special request to stay longer or shorter than the 7 days period initially planned. A request by email to reservation@dahuwakefamily.com must be formulated.

Modification
Toute modification de réservation est possible sans frais. Le Vendeur ne peut toutefois garantir à l'Acheteur la disponibilité des chambres. Dans le cas ou une modification ne serait pas possible, l'Acheteur devra respecter la réservation originale ou se soumettre aux conditions d’annulation. Pour tout départ anticipé,  les nuits restantes seront à la charge de l'Acheteur.

Cancellation
In case of cancellation within 30 days before the beginning of the stay or camp: deposit is refunded, except for administrative fees (20€). After this period, the deposit will be cashed.

In case of cancellation 7 days before the beginning of the stay or camp, 100% of the price of the stay or camp is due.

No cause for cancellation will be considered for any reservation made less than 48 hours before the arrival date. 

In case of refund of the stay or camp, bank charges may be retained.  

CONDITIONS DE RESERVATION, MODIFICATION ET D'ANNULATION POUR LES SEJOURS AU DAHU WAKE PARK (Sablons)

Reservation
All reservations must be accompanied by the payment of the chosen formula. The stay or camp is validated only once the payment is made.
Perhaps make a special request to stay longer or shorter than the period initially planned. A request by email to reservation@dahuwakefamily.com will have to be formulated.

Modification
Les clients peuvent demander à modifier leur réservation. Cependant, en raison des préparations nécessaires et des engagements pris par Dahu Wake Family envers d'autres parties, les modifications apportées à une réservation existante sont soumises aux conditions suivantes :

Modification effectuée jusqu'à 30 jours avant le début du séjour : aucune modification ne sera possible, et le montant total du séjour sera dû.

Ces frais reflètent les coûts que Dahu Wake Family doit engager pour reprogrammer les services à une date ultérieure et compenser pour les places qui ne peuvent plus être offertes à d'autres clients. Nous recommandons à nos clients de souscrire à une assurance voyage qui pourrait couvrir les frais de modification en cas de circonstances imprévues.
Pour tout départ anticipé,  les nuits restantes seront à la charge de l'Acheteur.

Toute demande de modification doit être envoyée par écrit à l'adresse e-mail reservation@dahuwakefamily.com. Les modifications ne sont effectives qu'après confirmation écrite de la part de Dahu Wake Family.
 
Cancellation
En cas d'annulation 30 jours avant le début du séjour ou camp, 100% du prix du séjour ou camp est du.

Aucune cause d’annulation ne sera prise en compte pour toute réservation faite moins de 30 jours avant la date d’arrivée.

CONDITIONS SPECIFIQUES LIEES A L'ENVIRONNEMENT NATUREL

Le Dahu Wake Park (Sablons) est situé dans un cadre naturel où la présence d'insectes (tels que les punaises des bois et les moustiques), d'oiseaux, rongeurs, reptiles et d'autres animaux est courante et peut varier selon les saisons. En raison de cet environnement, aucune annulation ou demande de remboursement ne sera acceptée en cas de phobies, d'allergies ou d'autres inconvénients liés à la faune et à la flore locales.

Pour assurer le confort de nos clients, nous mettons en œuvre des mesures actives pour contrôler et limiter la prolifération d'insectes et garantir la propreté de nos installations. Cependant, les clients doivent être conscients que la possibilité de rencontrer des insectes et des animaux ne peut être totalement éliminée.

Nous encourageons nos clients à prendre toutes les précautions nécessaires pour leur confort et à se préparer à séjourner dans un environnement naturel.

ARTICLE 11 - GUARANTEES

The Seller shall provide its services within the scope of its entrepreneurial resources and foreseeable requirements in a careful and professional manner, provided that Dahu Wake Family is not unable to provide the services for reasons for which it is not responsible.

The purchaser of the products is aware that the Seller provides its services via the Internet or by using communication networks. Temporary disruptions or interruptions to the performance of the services of https://www.dahuwakefamily.com may occur, in particular due to technical malfunctions, disturbances and interruptions of communication networks and due to failure of IT infrastructure, call center lines or other parts of the infrastructure necessary to perform the service. Therefore, the Seller does not provide any guarantee for the permanent availability and freedom from errors of its services. 



ARTICLE 12 - CLAIMS

If necessary, the Buyer can present any complaint by contacting the company by email or by simple letter.

ARTICLE 13 - INTELLECTUAL PROPERTY RIGHTS

The brands, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

ARTICLE 14 - FORCE MAJEURE

The performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure that would prevent the performance thereof. The seller shall notify the customer of the occurrence of such an event as soon as possible.

ARTICLE 15 - INVALIDITY AND MODIFICATION OF THE CONTRACT

Should any of the provisions of this contract be invalidated, such invalidity shall not entail the invalidity of the other provisions which shall remain in force between the parties. Any contractual modification is only valid after a written and signed agreement of the parties.

ARTICLE 16 - RGPD AND PERSONAL DATA PROTECTION

In accordance with the European regulation on the protection of personal data, you have the right to question, access, modify, oppose and rectify your personal data. By adhering to these general conditions of sale, you agree that we collect and use this data for the execution of the present contract.

ARTICLE 17 - APPLICABLE LAW

All the clauses contained in the present general terms and conditions of sale, as well as all the purchase and sale operations referred to therein, shall be subject to Swiss law.
